Terms and Conditions

This English version is provided for convenience. In case of discrepancies, the German version shall prevail.

Scope

All products and services are subject to the General Terms and Conditions (GTC) of Sonnerie GmbH. These GTC apply to all transactions and deliveries. Conflicting or deviating terms and conditions are not recognised unless Sonnerie GmbH expressly agrees to them in writing.

No guarantee for information

Sonnerie GmbH endeavours to provide its customers with the best possible information about its range and services. Some of this information is provided to us directly by manufacturers and suppliers. We strive to present it in the most customer-friendly way possible. However, Sonnerie GmbH accepts no liability for any information regarding its range, availability, delivery times, services, warranty terms or warranty periods. This information may not be understood as a binding assurance. We accept no liability for its accuracy, timeliness or completeness.

Prices

The prices published at www.sonnerieuhren.ch at the time of ordering apply. All prices are in Swiss francs and include statutory VAT. Customers may pay using the payment methods offered at www.sonnerieuhren.ch. Any "instead of" prices shown correspond to competitor prices or non-binding recommended retail prices in Switzerland. No liability is accepted for deviating competitor prices or recommended retail prices. Sonnerie GmbH reserves the right to change prices at any time.

Delivery & shipping costs

Delivery is made to the delivery address provided by the customer.

Deliveries within Switzerland and Liechtenstein are free of charge.

For deliveries within Europe, a flat shipping fee of CHF 50.– per order is charged.

For worldwide deliveries outside Europe, the flat shipping fee is CHF 100.– per order.

Any applicable shipping costs are shown during the ordering process and invoiced in addition to the price of the goods.

Unless expressly agreed otherwise, delivery is at the expense and risk of the customer. Benefit and risk pass to the customer upon handover of the goods to the carrier (Art. 185 of the Swiss Code of Obligations).

The stated delivery periods and dates are for guidance only and are non-binding unless expressly agreed in writing as binding. Compliance with delivery periods is subject to timely and proper delivery by our suppliers. Unforeseeable delivery delays do not give rise to any claim for damages.

Sonnerie GmbH is entitled to make partial deliveries where this is reasonable for the customer. Any additional shipping costs arising from partial deliveries are borne by Sonnerie GmbH.

The customer is obliged to inspect the goods immediately upon receipt and to report any defects, in particular transport damage, incorrect or incomplete deliveries, in writing within 7 calendar days. If the customer fails to do so, the delivery is deemed accepted (Art. 201 of the Swiss Code of Obligations).

Conclusion of contract

The range, prices and services published on the Sonnerie GmbH website constitute an offer. However, these offers are always subject to the (resolutory) condition that delivery is impossible or that a price has been stated incorrectly by the manufacturer or by Sonnerie GmbH.

As soon as the customer places an order online, by e-mail, by telephone or in the shop, a contract is concluded. An automatically generated order confirmation by e-mail informs the customer that their order has been received by Sonnerie GmbH.

Receipt of this automatically generated order confirmation, including the order number, is no assurance that the product is actually available or can be delivered. The order confirmation merely informs the customer that the order has been received by Sonnerie GmbH. A contract has thus been concluded, which may be dissolved in the event of non-delivery. The occurrence of one of the above resolutory conditions dissolves the contract immediately and without the involvement of the parties. If the contract is dissolved, Sonnerie GmbH is not obliged to deliver a replacement.

Cancellation and termination of contract

Orders placed with Sonnerie GmbH are binding, meaning the customer must accept the goods or services. This does not affect the 14-day right of return in accordance with our return conditions. Sonnerie GmbH may, at its discretion, permit subsequent changes or cancellations in special cases. Handling fees may apply. The handling fee amounts to 20% of the order value plus the loss in value of the product since the order was placed.

The customer has seven days to accept the products; otherwise Sonnerie GmbH is entitled to dissolve or cancel the contract and charge handling costs.

If Sonnerie GmbH is unable to deliver the order because delivery is impossible, the customer may withdraw from the contract no earlier than four weeks after the agreed delivery date. Any amounts paid in advance will be refunded to the customer due to non-delivery.

Warranty

For products not manufactured by Sonnerie GmbH itself, Sonnerie GmbH has no influence on the functionality of the products or on the manufacturers’ warranty services. The manufacturer’s warranty terms and warranty period always apply. In the event of a warranty claim, Sonnerie GmbH will initiate the process with the manufacturer on behalf of the customer.

Warranty services are provided unless there are grounds for exclusion such as improper or harmful handling or other damage. Damage caused by natural forces, moisture damage, damage from falls and impacts, and excessive wear are not covered by the warranty. Wear parts such as straps, batteries and the like are excluded from the warranty.

Warranty services do not extend the original warranty period.

Applicable law and place of jurisdiction

These GTC and all contractual relationships between the provider and the customer are governed by Swiss law. The exclusive place of jurisdiction is Arbon, Switzerland.

Sonnerie GmbH is entitled to amend these GTC at any time.
